DMCA Policy

Savory ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using Savory (the "Service").

2. Filing a DMCA Takedown Notice
If you believe that content available on or through Savory infringes your copyright, you may submit a written notification to our DMCA Agent. To be effective, your notification must include the following:

- Physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URL or specific description).
- Your contact information, including your name, address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorney's fees.
3. What Happens After You Submit a Notice
Upon receipt of a valid DMCA notice, we will:
- Remove or disable access to the allegedly infringing material
- Notify the user who posted the material that it has been removed
- Provide the user with a copy of the takedown notice (with your personal information redacted unless you specify otherwise)
- Inform the user of their right to submit a counter-notification
4. Counter-Notification Process
If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our DMCA Agent. Your counter-notification must include:

- Your physical or electronic signature
- Identification of the material that was removed and the location where it appeared before it was removed
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the federal district court for your address (or if outside the United States, any judicial district in which we may be found)
- A statement that you will accept service of process from the party who filed the original DMCA notice or their agent
4.1 What Happens After Counter-Notification
Upon receipt of a valid counter-notification, we will:
- Forward a copy to the original complainant
- Inform them that we will restore the removed content in 10 business days
- Restore the content within 10-14 business days unless we receive notice that the original complainant has filed a court action seeking to restrain you from engaging in infringing activity
5. Repeat Infringer Policy
ACCOUNT TERMINATION FOR REPEAT INFRINGERS
In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
We define a "repeat infringer" as any user who has been the subject of more than two valid DMCA takedown notices. Upon the third valid notice, we will terminate the user's account.
6. Modifications to This Policy
We reserve the right to modify this DMCA Policy at any time. We will notify users of any material changes by posting the new policy on this page and updating the "Last updated" date. Your continued use of the Service after any changes indicates your acceptance of the modified policy.
7. Good Faith Requirement
We expect all parties to act in good faith when submitting DMCA notices and counter-notifications. Abuse of the DMCA process, including filing false claims, may result in:
- Liability for damages under Section 512(f) of the DMCA
- Termination of your Savory account
- Legal action by the affected parties
